1. Agreement to These Terms

By creating an account or using BuildOrder.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and BuildOrder.ai.

2. What BuildOrder.ai Is — and Is Not

BuildOrder.ai is a software-as-a-service platform that uses artificial intelligence to help contractors generate business documents including estimates, contracts, invoices, change orders, lien waivers, subcontractor agreements, and material takeoffs.

BuildOrder.ai is not a law firm and does not provide legal advice. Use of this Service does not create an attorney-client relationship. The documents produced by the Service are generated by AI based on the information you provide. They are intended as a starting point — not a legal guarantee.

You are solely responsible for:

• Reviewing all generated documents before using them
• Ensuring documents comply with your state's laws and regulations
• Having documents reviewed by a licensed attorney when appropriate
• The accuracy of the information you input

3. Accounts

You must provide accurate, complete information when creating your account. You are responsible for maintaining the security of your account credentials. You may not share your account with others or transfer it without our consent. You must notify us immediately at support@buildorder.ai if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

BuildOrder.ai offers a free tier and paid subscription plans. Paid plans are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — there are no refunds for partial periods. Free tier access continues after cancellation.

We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Payment Collection Feature

BuildOrder.ai offers an optional feature that allows you to collect payments from your clients through Stripe. When you use this feature, you are acting as the merchant and are solely responsible for the goods and services provided to your clients. BuildOrder.ai is not a party to transactions between you and your clients. All payment disputes, refunds, and chargebacks are governed by your agreement with Stripe.

To use payment collection, you must agree to Stripe's Terms of Service.

6. Electronic Signatures

The eSign feature allows your clients to sign documents electronically. Electronic signatures collected through BuildOrder.ai are intended to comply with the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA). However, it is your responsibility to ensure that electronic signatures are legally sufficient for your specific document and jurisdiction. BuildOrder.ai makes no warranty that any electronic signature will be enforceable in court.

7. Acceptable Use

You agree not to use the Service to:

• Generate fraudulent documents or misrepresent facts in any document
• Harass, threaten, or deceive any person
• Violate any applicable law or regulation
• Attempt to circumvent subscription limits or access controls
• Reverse engineer or copy any part of the Service
• Use the Service for any purpose other than legitimate contractor business document generation

8. Intellectual Property

BuildOrder.ai and its underlying technology are owned by BuildOrder.ai and protected by intellectual property laws. You retain ownership of the content you input and the documents generated from your specific job details. We retain ownership of the Service, its design, code, and AI models.

You grant BuildOrder.ai a limited license to process your content solely to provide the Service to you.

9. Limitation of Liability

To the maximum extent permitted by law, BuildOrder.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, business interruption, or damages arising from reliance on AI-generated documents.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to BuildOrder.ai in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that generated documents will be legally valid, enforceable, or suitable for any particular purpose.

11. Indemnification

You agree to indemnify and hold harmless BuildOrder.ai and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) content you input, (c) documents you generate and use, or (d) your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Cobb County, Georgia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
